Privacy policy

What data I collect, why, how long I keep it and what your rights are. Particular care is given to young athletes and their health data, in accordance with the General Data Protection Regulation (GDPR).

This English version is provided for convenience. In case of discrepancy, the French version prevails.

1. Data controller

The data controller is Jérôme Devos, self-employed sole trader trading as BodyFitWithMe, EREPS-certified sports nutrition coach.

  • Address: Rue Joseph Verhasselt 34, 1083 Ganshoren (Brussels), Belgium
  • Company number (Crossroads Bank for Enterprises, BCE/KBO): 1023.085.724
  • Email: info@fitwithme.be
  • Phone and WhatsApp: +32 495 77 99 77

Given the size of the business, no data protection officer has been appointed. For any question, write directly to info@fitwithme.be.

2. Data collected

Depending on your situation (visitor, prospective client or client), I may process the following data:

  • Identity and contact details: surname, first name, email, phone or WhatsApp number, postal address where needed for invoicing.
  • Sporting profile: age, club or academy, age group, level, sport played, number and times of training sessions and matches, goals.
  • Body and health data: height, weight, body composition measurements (skinfolds, body fat, body measurements), progress photos, allergies and intolerances, sleep, injuries and medical information relevant to the follow-up.
  • Eating habits: meals, meal times, where meals are eaten (home, boarding, canteen), foods refused, hydration, everyday constraints.
  • Coaching follow-up: weigh-ins and weekly data, exchanges, assessments and plans provided.
  • Payment: programme subscribed, amounts, dates and payment status. Card and bank account details are entered directly with Stripe: I never have access to them and I do not store them.

Body and health data fall within the special categories of data under Article 9 of the GDPR. They benefit from the enhanced protection described in section 5.

3. Purposes, legal bases and retention periods

These periods constitute the retention policy of BodyFitWithMe. At the end of them, the data is deleted or irreversibly anonymised. I do not use your data for any automated decision-making or profiling.

4. Data of young athletes under 18

BodyFitWithMe mainly works with players aged 12 to 17. The contract is concluded with the parent or legal guardian, who remains the point of contact for any decision relating to the coaching. The data of a minor, and in particular their health data, is only processed with the explicit consent of that parent or legal guardian.

The website's forms (contact, calculator, questionnaire, audit, application) relating to a player under 18 must be completed by a parent or with a parent's consent. If I learn that a minor has sent me data without this consent, I contact their parents or delete the data.

The parent or legal guardian may at any time consult their child's data, have it corrected or deleted, and withdraw their consent. No photo or testimonial of a minor is published without the prior written consent of their parents.

5. Your health data

Health data is processed solely on the basis of your explicit consent (Article 9(2)(a) GDPR), given when submitting a form or at subscription, and for a minor by their parent or legal guardian. It is limited to what is strictly necessary for the follow-up, accessible only to Jérôme Devos, and is never used for advertising purposes or shared with a club, a coach or an agent without your consent.

You may withdraw this consent at any time, simply by email. Withdrawal applies for the future and does not affect processing already carried out. As the nutrition follow-up cannot take place without this data, withdrawal ends the follow-up, under the conditions set out in the Terms and Conditions of Sale.

6. Recipients and processors

Your data is never sold or rented. It is processed by Jérôme Devos and, for strictly technical purposes of the service, by the following providers:

  • Netlify (United States): website hosting and receipt of contact form messages (Netlify Forms).
  • Zoho Mail (hosted in the European Union): mailbox for the address info@fitwithme.be.
  • Make (servers in the European Union): automations for the calorie calculator and the nutrition questionnaire.
  • Google (Google Sheets, Google Drive and Google Apps Script), Make and Brevo (email delivery, Sendinblue SAS, France): recording requests and sending the PDF of the protocol and of the 7-12 guide, as well as any advice by email.
  • FormSubmit (formsubmit.co): forwarding the Pro · Elite application form by email.
  • Stripe: online payments, SEPA direct debit mandates and receipts.
  • Azeoo: platform that runs the FitWithMe follow-up app.
  • Meta Platforms Ireland Limited: Meta pixel on the free audit (audit.fitwithme.be), only after your consent (see section 8).
  • WhatsApp (Meta): exchanges with clients and prospective clients who choose this channel.
  • Google Search Console: aggregate statistics on the website's visibility in Google search results, with no cookie or tracker on the website.

The nutrition audit (audit.fitwithme.be) is hosted by Netlify. Your answers are recorded in the BodyFitWithMe contact management tool, also hosted by Netlify, and then used to send you your result by email and, if you have indicated so, by WhatsApp.

These providers act only on my instructions or under their own terms of service, and are bound to an appropriate level of security and confidentiality. I may also disclose data to my accountant or to an authority where required by law.

7. Transfers outside the European Union

Some providers, in particular Netlify, Stripe, Google, Meta (WhatsApp and the Meta pixel, including where data is first collected by Meta Platforms Ireland Limited) and FormSubmit, may process data in the United States or in other countries outside the European Economic Area. These transfers are based on the European Commission's adequacy decision on the EU-US Data Privacy Framework where the provider participates in it, or failing that on the standard contractual clauses adopted by the European Commission. You can obtain information about these safeguards by writing to me.

8. Cookies and trackers

fitwithme.be website: no cookies

The fitwithme.be website does not place any cookies and does not use any trackers: no audience measurement tool, no advertising pixel. The only exception: your browser remembers, on your device only, that you have closed the cookie information message (no personal data, nothing is sent). Fonts are hosted on the website itself and no social media content is embedded. Links to Instagram, TikTok, Facebook, LinkedIn or WhatsApp are simple links: these services only receive information if you click on them, under their own privacy rules. This is why no consent banner is displayed. Should an audience measurement or advertising tool be added, a banner allowing you to accept or refuse these cookies would be put in place beforehand and this policy would be updated.

Free audit at audit.fitwithme.be: Meta pixel, with your consent

The free nutrition audit, to which the website's "audit" buttons lead, is a separate website, audit.fitwithme.be. It uses the Meta pixel (Facebook and Instagram), an advertising cookie and tracker. Its sole purpose is to measure the effectiveness of my advertising campaigns on Facebook and Instagram: knowing how many people reach the audit and complete it after seeing an advert.

  • Prior consent: the Meta pixel is only activated after you have accepted it in the banner displayed when you arrive on the audit. If you refuse or ignore the banner, no Meta cookie is placed and you can complete the audit as normal.
  • Recipient: Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland, which receives in particular information about your browser, the pages viewed and the actions taken on the audit. Transfers to Meta Platforms, Inc. in the United States may take place; they are based on the EU-US Data Privacy Framework, in which Meta participates. The pixel's advanced matching feature is enabled: if you accept advertising cookies, certain contact details entered in the audit (email address, phone number, first name) are sent to Meta in encrypted (hashed) form in order to measure the effectiveness of the adverts. Without your consent, nothing is sent. Your answers about your diet, your weight or your health are never sent to Meta.
  • Duration: Meta cookies are kept in your browser for a maximum of 90 days for the _fbp cookie, and for the periods set by Meta for its other cookies.
  • Withdrawal: you may withdraw your consent at any time via the audit's cookie management link, or by deleting cookies in your browser settings. Withdrawal applies for the future.

For the use Meta makes of this data as controller of its own processing, please see Meta's privacy policy.

9. Your rights

Under the GDPR, you have the following rights over your data:

  • right of access: to obtain a copy of your data;
  • right to rectification: to correct inaccurate or incomplete data;
  • right to erasure: to have your data deleted, unless there is a legal obligation to retain it;
  • right to restriction: to have processing temporarily suspended;
  • right to object: to object to processing based on legitimate interest, and at any time to receiving advice by email;
  • right to data portability: to receive the data you have provided to me in a structured, machine-readable format;
  • right to withdraw your consent at any time, without affecting processing already carried out.

To exercise these rights, write to info@fitwithme.be. I reply within one month, which may be extended by two months for a complex request, in which case I will let you know. I may ask you to prove your identity or, for a minor, your status as parent or legal guardian.

10. Lodging a complaint

If you believe your data is not being processed correctly, you may lodge a complaint with the Belgian Data Protection Authority, Rue de la Presse 35, 1000 Brussels, autoriteprotectiondonnees.be. Do feel free to write to me first: most questions are resolved quickly.

11. Security

I implement appropriate technical and organisational measures to protect your data against loss, unauthorised access, alteration or disclosure: encrypted connection (HTTPS) across the whole website, data access restricted to Jérôme Devos, password-protected professional accounts, use of recognised providers and collection limited to what is necessary. In the event of a data breach likely to present a risk to you, I inform the Data Protection Authority and, where required by law, the persons concerned.

12. Changes

This policy may change, in particular if new tools are used. The applicable version is the one published on this page. In the event of a significant change, clients currently being coached will be informed.
